These Terms govern your access to and use of the Konnectify platform, website and APIs (the “Service”), operated by Goftech Solutions (“Konnectify”, “we”, “us”). By creating an account or using the Service, you (“you”, the “merchant”) agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility & accounts
You must be at least 18 and able to enter a binding contract; if you use the Service on behalf of a business, you confirm you are authorized to bind it. You are responsible for activity under your account and for keeping your credentials secure. Notify us immediately of any unauthorized use.
2. The Service
Konnectify provides tools to manage e-commerce operations — order management, courier/shipment booking, point of sale, a WhatsApp customer inbox, marketing analytics, expenses, purchase orders, reporting and staff management. Features available to you depend on the modules enabled for your organization.
3. Subscriptions & payments
- Access: accounts are created and configured by us on request — there is no self-service sign-up. Contact us to arrange access.
- Manual billing: any fees are agreed and billed manually/offline — the Service contains no payment gateway and never charges you automatically.
- Suspension: if an agreed term is not renewed, access may be suspended until the account is reactivated. Your data is retained, not deleted.
- Refunds: fees are non-refundable except where required by law.
4. Connected services & your responsibilities
You may connect third-party services (Shopify, WooCommerce, WhatsApp, Meta, couriers). You are responsible for:
- Complying with the terms and policies of each connected service.
- Having the necessary rights and lawful basis to upload and process your customers’ data through the Service.
- Obtaining any required consent before sending messages to your customers (including WhatsApp), and ensuring such messaging complies with applicable law and platform rules.
5. Acceptable use
- No unlawful, infringing, harmful or fraudulent activity.
- No spam or unsolicited messaging in breach of applicable law or platform policies.
- No reverse engineering, scraping, or attempts to disrupt or gain unauthorized access to the Service.
- No reselling or sublicensing the Service without our written permission.
Violation may result in suspension or termination without refund.
6. Data Processing Agreement (DPA)
This section applies where Konnectify processes personal data of your customers (shoppers) on your behalf. For that data, you are the data controller and Konnectify is the data processor. We agree that:
- Scope & instructions: we process such personal data only to provide the Service and on your documented instructions, not for our own purposes.
- Confidentiality: personnel authorized to process the data are bound by confidentiality obligations.
- Security: we maintain appropriate technical and organizational measures — encryption in transit, encryption of sensitive credentials at rest, multi-tenant isolation, role-based access controls and two-factor authentication.
- Sub-processors: we use the sub-processors listed in our Privacy Policy (e.g. Shopify, Meta/WhatsApp, courier and infrastructure providers) under comparable data-protection obligations.
- Data-subject requests: we will assist you, taking into account the nature of the processing, in responding to requests from data subjects to exercise their rights.
- Erasure: we delete or return personal data on termination, and — for Shopify — we honour the mandatory
customers/redactandshop/redacterasure webhooks. We also action manual deletion requests (see Data Deletion). - Assistance & incidents: we will support you in meeting your security and breach-notification obligations and will notify you without undue delay of a personal-data breach affecting your data.
7. Intellectual property
All rights in the Service, including its software, design and content, belong to Goftech Solutions. You retain ownership of your data and your customers’ data; you grant us a limited licence to host and process it solely to provide the Service.
8. Termination
You may stop using the Service at any time and request account deletion. We may suspend or terminate access for breach of these Terms or for non-payment. On termination, your access ceases and your data is handled as described in our Privacy Policy and Data Deletion page.
9. Disclaimer
The Service is provided “as is” and “as available”, without warranties of any kind. We do not guarantee uninterrupted or error-free operation, or any particular results from third-party services you connect.
10. Limitation of liability
To the maximum extent permitted by law, Konnectify is not liable for indirect, incidental or consequential damages. Our total aggregate liability is limited to the subscription fees you paid for the Service in the 12 months preceding the claim.
11. Governing law
These Terms are governed by the laws of Pakistan, and the courts of Islamabad have jurisdiction, without prejudice to any mandatory consumer-protection rights you may have.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance.
